Kay Casto & Chaney’s labor and employment law practice relies upon the various talents, backgrounds, and experience of its members to represent and advise clients in this particular area of business.

A large part of our attorneys’ work is devoted to representation in all phases of litigation before administrative agencies and in state and federal court. Our firm’s employment law attorneys have tried cases in the areas of age, sex, race, disability, and gender discrimination as well as in retaliatory discharge and implied employment contract actions. Our firm regularly represents clients in administrative proceedings before the West Virginia Human Rights Commission, the West Virginia Division of Labor, and the Charleston Human Rights Commission. The firm’s appellate practice has included cases before the Supreme Court of Appeals of West Virginia and the United States Court of Appeals for the Fourth Circuit.

Just as important as the firm’s litigation practice, however, is the attorneys’ risk management work. Our legal teams routinely advise and counsel clients to assist the management of their workforce as a means of avoiding litigation before it is instituted.

With respect to specific matters in the workplace, our lawyers often advise clients regarding employee handbooks, discipline, and discharge decisions. Our lawyers have extensive experience in labor matters, including negotiating labor contracts and dealing with labor disputes through negotiation, mediation, and injunctive relief. In addition, our firm has a successful history of appearing before the National Labor Relations Board.
