Workers’ Compensation

The firm’s workers’ compensation practice represents employers across the spectrum from small, closely held family businesses to national corporations. We represent employers in a wide variety of state workers’ compensation matters, including traumatic injury claims, occupational pneumoconiosis (black lung), hearing loss and other progressive disease claims, and any other matters related to workers’ compensation. In addition, we represent employers in claims filed under the federal black lung program, from agency filings through the administrative process and appeals.

Through the years there has been much interplay between the West Virginia Legislature, the former Workers’ Compensation Division and Commission, Office of Judges and Board of Review, and the Supreme Court of Appeals with respect to compensation matters, from the major statute revisions first enacted in 1995, subsequent enactments and major court decisions, and culminating in the privatization of the workers’ compensation system beginning in 2006 and the opening of the insurance market two years later. Additional regulations have been promulgated to give effect to these changes, and West Virginia’s workers’ compensation law continues to evolve.
