January 20, 2012, Kay Casto & Chaney is proud to announce that three of its members have been named "Lawyer of the Year" by Best Lawyers. Craig M. Kay has been named the Best Lawyers’ 2012 Charleston-WV Litigation & Controversy - Tax Lawyer of the Year. Robert B. Allen has been named the Best Lawyers’ 2012 Charleston-WV Mediation Lawyer of the Year. William W. Booker has been named the Best Lawyers’ 2012 Charleston-WV Bankruptcy and Creditor Debtor Rights / Insolvency and Reorganization Law Lawyer of the Year.

September 8, 2011, member attorney John R. McGhee, Jr. served as an adult volunteer for a first public showing of the new Boy Scouts of America high adventure base in Fayette County. This showing will include a public flag raising ceremony on the property with Stephen Bechtel of the Bechtel family and Bechtel Construction who donated $50M to the project.

August 1, 2011 Kay Casto & Chaney PLLC announced today Robert B. Allen has joined its Charleston office. “We are proud to have an attorney of Bob’s skill and character join our firm,” said Michael T. Chaney, a member of the law firm’s management committee. “Bob is an extremely highly regarded litigator and mediator; his litigation practice includes high-profile civil matters and white-collar criminal cases,” Chaney added.
July 27, 2011 WV Circuit Court Judge Phillip D. Gaujot granted summary judgment and ruled in favor of the Plaintiffs, represented by Shannon P. Smith, moments before a jury was selected, on a counterclaim filed by the Defendant, who was a tenant of a residence owned by the Plaintiffs, alleging that the Plaintiffs should pay for the damages to his personal property following multiple pipes freezing and bursting in the residence.

Bandy presented the Entertainment Art Law for Film Workshop, which included issues that often arise during screenwriting, pre-production, production, and post-production at West Virginia State University. Additionally, the discussion included agreements and licenses, and provide basic background on copyright law.

KCC Attorneys Erin J. Webb and Jack Hoblitzell, after a four day trial in the Circuit Court of Kanawha County, obtained a directed verdict in favor of their client, the Plaintiff, in seeking to enforce the terms of a commercial lease against a tenant who failed to pay rent and who damaged our client’s property in violation of the lease while vacating the property at the end of the term.

Kay Casto & Chaney PLLC announced today that it has opened a branch office located at Corridor G in the professional building that houses The Pied Piper of Charleston, Inc. The office serves as the home of the firm’s Entertainment Law Group, headed by attorney L. Kevin Levine. In addition to office and conference room space for the Entertainment Law Group, the facility also features a 45-seat auditorium for seminars and workshops. Member attorney John R. McGhee served as co-chairman of the Boy Scout Camporee held on the WV State Capitol grounds as part of the Buckskin Council’s celebration of the 100th Anniversary of Boy Scouting in America. More than 700 campers spent the night at the Capitol and approximately 1,500 participated in the Saturday's scouting and high adventure activites.

Applied Industrial Technologies, Inc. v. Kiptin Developers, LLC
In a jury trial before WV Circuit Court Judge Fred Fox, the Plaintiff, a multi-national industrial supply company which is the tenant of a building owned by the Defendant, alleged that the Defendant should have paid for the damages to its business personal property following a December 2005 fire. After a three-day trial, (the jury deliberated for over two hours) before ruling in favor of the Defendant, which was represented by Kay Casto & Chaney PLLC attorneys Teresa J. Dumire and Shannon P. Smith and co-counsel William E. Galeota of Steptoe & Johnson.

Xavier "Javie" Staggs and Steven L. Thomas received summary judgment for our client, a student loan guaranty agency. The motion successfully argued that the Higher Education Act preempts the West Virginia Consumer Credit and Protection Act and other state law claims.

Attorney L. Kevin Levine successfully argued before the West Virginia Supreme Court of Appeals. As a result of his September appearance, the state Supreme Court has reversed a decision by the state Human Rights Commission involving two African American teenagers who were asked to leave Charleston Town Center for disruptive behavior as reported in the Charleston Daily Mail.

The West Virginia Supreme Court of Appeals decided a case that may affect how subpeonaes are served. In State ex rel. Progressive Classic Ins. Co. v. Bedell, No. 34858, the Court held that a subpoena may be served through the Secretary of State upon a non-party corporation for a W.V.R.C.P. 30(b)(7) deposition and a corporation is subject to contempt and sanction orders if it fails to timely respond.

John R. McGhee, Jr. and Erin K. Jones obtained summary judgment on behalf of Old Republic Insurance Company in a federal declaratory judgment action involving an insurance coverage dispute, successfully dismissing the action against their client.

Xavier "Javie" Staggs obtained summary judgment on all counts for his client, Pocahontas Memorial Hospital, in a suit alleging slander, libel, and tortuous interference with a business relationship.
