Employment and Labor Law

The firm's Employment and Labor Law Practice Group relies upon the various talents, backgrounds, and experience of its members to represent and advise clients in this area of the law. A large part of the Employment Law Practice Group's work is devoted to representation in all phases of litigation before administrative agencies and in state and federal court. The firm's employment law attorneys have tried cases in the areas of age, sex, race, disability, and gender discrimination as well as in retaliatory discharge and implied employment contract actions. The firm also has represented clients in administrative proceedings before the West Virginia Human Rights Commission, the Charleston Human Rights Commission, and the West Virginia Division of Employment Security. Appellate practice has included cases before the Supreme Court of Appeals of West Virginia and the United States Court of Appeals for the Fourth Circuit.

Just as important as its litigation practice, however, is the Practice Group's risk management work and its efforts to use alternative dispute resolution as means of avoiding litigation before it is instituted. Our lawyers often advise clients regarding employee handbooks, discipline and discharge decisions. We also recommend the use of mediation and arbitration to settle disputes when we think it is in our client's best interest. The Employment Law Practice Group also has extensive experience in labor matters, including negotiating labor contracts and dealing with labor disputes through negotiation, mediation, and injunctive relief, as well as practice before the NLRB. Our Group is capable of providing advice and representation on any employment law issue that you may face.
