Alternative Dispute Resolution

The Alternative Dispute Resolution (ADR) Practice Group at Kay Casto & Chaney PLLC contains members who are recognized throughout the state as being in the forefront of Alternative Dispute Resolution. Working in the areas of mediation and arbitration, these attorneys bring to ADR their many years of practice in helping others to work out solutions to their disputes.

Mediation is now an established method of attempting to come to settlement in West Virginia. Beginning as litigators with many years of practice behind them and expanding to learn the skills necessary to bring parties together, our mediators have been hired in a variety of subject areas such as wrongful death, personal injury, contracts, sexual harassment, wrongful discharge, medical malpractice, and premises liability.

Arbitration in complex contractual cases is being used more and more. Many of our arbitrators are panel members of the American Arbitration Association and have experience in such areas as coal-related disputes, contract cases, and damage assessments.

Education is seen at Kay Casto & Chaney PLLC as an essential part of effective Alternative Dispute Resolution. Our members have taken advantage of every opportunity to hone the specific skills that are necessary to a good mediator, including attending the Basic and Advanced Mediator Training offered by the West Virginia State Bar, coordinating and speaking at seminars, and participating in the State Bar's Alternative Dispute Resolution Committee and several of its Subcommittees.
